1. WHAT INFORMATION DO WE COLLECT FROM YOU?

Also, upon written request, BEYOND MIRACLES will functionally delete the user and his or her Personal Information from the database where such information is stored; however, it may be impossible to delete a user’s entry without some residual information being retained because of the nature in which backups of data are maintained. 2.1 General. The information we collect depends on what users do when they visit or utilize the Website. We collect Personal Information and Non-Personal Information in various ways, as described below.

2.2 Information Collected From You. You will have the opportunity to voluntarily provide us with Personal Information and Non-Personal Information when you visit or utilize the Website. We collect such information directly from you in various ways including:

If you purchase a gift certificate at our online store, we will also collect the name, email address, mailing address, and telephone number of the recipient. Before confirming your order, you will have the opportunity to review the order form and make changes and additions to the information it contains and these changes will automatically be kept for future use. If you cancel an order or do not complete an order, we may collect and use any email address or other information that you have entered as we would collect and use it if you had completed an order.

(c) For subscribers to our website. If you sign up for information relating to the BEYOND MIRACLES Newsletter, we will collect and maintain your name, email address, mailing address, and telephone number. If you cancel a subscription, we may collect and use any email address or other information that you have entered.

2.3 Information Collected Through Technology. We or our third-party service providers may collect information from visitors to the Website regarding the referring URL, your IP address, which browser you used to come to the Website, information regarding your domain server, the country, state, and telephone area code where your server is located, your type of computer, timestamp data and the pages of the Website that you viewed during your visit. 3.1 Use of Personal Information and Non-Personal Information. We use Personal Information and Non-Personal Information in order to fill your orders, communicate with you about your orders or other requests, and to send you informational and promotional materials, including upcoming BEYOND MIRACLES promotions and events. However, BEYOND MIRACLES may disclose your Personal Information to related parties for legitimate business purposes, as described below. Such related parties may use your Personal Information only to the extent permitted by BEYOND MIRACLES pursuant to this Privacy Policy.

(b) Service Providers. We may disclose your Personal Information to our third-party service providers that assist us in operating the Website and otherwise providing our services to you. For example, we will release your credit card number to our payment processor to confirm your payment, and we will release your name and mailing address to the delivery service to deliver and track the products that you ordered. With respect to Non-Personal Information, we also share website usage information we gather from visitors to the Website who have received a targeted promotional campaign through our third-party advertising service partners for the purpose of targeting future campaigns and upgrading visitor information used in reporting statistics. 4. SAFEGUARDING YOUR PERSONAL INFORMATION.

4.1 Our Security Measures. In order to most efficiently serve you, credit card transactions and order fulfillment are handled by established third-party banking institutions, process agents, and distribution institutions. They receive the information they need to verify and authorize your credit card transactions and ship your order. When collecting credit card information for online purchases, we offer secured server transactions that encrypt your information in transit to prevent someone from intercepting it and misusing it. When you access your account information, the information is kept on a secure server. Furthermore, all of the customer data we collect is protected against unauthorized access by physical security means. Although BEYOND MIRACLES uses reasonable efforts to safeguard the security of your Personal Information, transmissions made on or through the Internet are vulnerable to attack and cannot be guaranteed to be secure. In addition, submissions made via email are not protected by SSL technology and are vulnerable to interception during transmission. You hereby acknowledge that BEYOND MIRACLES is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.

4.2 Protecting Yourself. You are solely responsible for safeguarding and maintaining the secrecy of your User ID, passwords, and/or any account information in your possession or control. Please be careful and responsible whenever you are online.

5. GENERAL

5.1 Data Retention. We will retain your Personal Information while you maintain an account with us or to the extent necessary to provide the services through the Website. Thereafter, we will keep Personal Information for as long as necessary: (i) to respond to any queries from users; (ii) to demonstrate we treated users fairly; (iii) for ordinary business continuity procedures; or (iv) to comply with any applicable laws. We delete Personal Information within a reasonable period after we no longer need the information for the purposes set out in this Privacy Policy. Note that we cannot remove your Personal Information when there is a legal storage requirement or when there are other legal grounds to keep the Personal Information, such as an ongoing contractual relationship.

5.2 California Privacy Rights. California’s “Shine the Light” law permits users of the Website that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. 5.3 Do Not Track Disclosure. Some internet browsers may transmit “do-not-track” signals to websites with which the browser communicates. The Site does not currently respond to these “do-not-track” signals.

We do not participate in bulk email solicitations that you have not consented to receiving (i.e., “Spam”).  We do not sell or disclose customer lists or email address lists to unrelated third parties. Except as otherwise provided herein, we do not share Personal Information with any third party advertisers.

5.5 Linked Sites. The Website may include links to other websites which do not fall under our supervision (“Linked Sites”). We do not control the collection or use of any information, including Personal Information, which occurs while you visit Linked Sites. Therefore, we make no representations or warranties for—and will not in any way be liable for—any content, products, services, software, or other materials available on Linked Sites, even if one or more pages of the Linked Sites are framed within a page of the Website. 

Furthermore, we make no representations or warranties about the privacy policies or practices of the Linked Sites, and we are not responsible for the privacy practices of those Linked Sites. We encourage you to be aware of when you leave the Website and read the privacy policies of Linked Sites.

5.6 Children’s Information. We do not offer our services or promote the Website to, nor do we intentionally collect or retain Personal Information from, children who are younger than 18 years of age. If we discover that we have inadvertently collected information from a child under 18 years of age, we will promptly take all reasonable measures to delete such information from our systems.
